When Should You Hire An Attorney If You Have Been In A Car Accident And When Should You Represent Yourself
By Jimmy W. Howard, Esq.
A car accident is a very stressful situation. The accident itself is bad enough. But there is a cascade of consequences and responsibilities that follow the accident that adds to the anxiety and stress of the situation and to your daily life. When should you hire an attorney and when shouldn’t you probably sounds like a question that a law firm is going to answer always hire an attorney. But, that is really not true. What is true is this, you should probably always talk to an attorney if you have been in an accident. Every attorney here at Craig P. Kenny & Associates is happy to consult with you for free after you have been in an accident. We can offer you some pointers about how to go forward even if we do not end up representing you.
So, when should you hire an attorney if you have been in a car accident? If you have been injured in an accident that the other party caused, you should almost always hire an attorney to represent you. First, if you have been injured, your primary focus should be getting better. Many times, that will require medical treatment. We can help you arrange that treatment and make sure there is insurance coverage to pay for the treatment so that you are not the victim a second time when the bills come due. And, we can find out all applicable insurance coverage that might be available. That might sound simple, but here are various scenarios we encounter frequently that would probably present a difficulty for a non-lawyer in pursuing a claim: (1) a state, federal, other governmental entity, or corporation causes an accident, (2) a tourist from another state or a foreign country causes an accident while driving a rental, (3) a person driving another person’s car causes an accident, (4) a minor driving their parent’s car causes an accident, (5) a person that does not have insurance causes an accident, (6) a person driving a stolen car causes an accident. What happens in each of these scenarios, and even in what may seem to be simple scenarios, is different and the attorneys at Craig P. Kenny & Associates are experienced in handling each of them hundreds if not thousands of times. But, a person who is representing themselves can easily get lost in a complex web of what insurance is available for a claim and even how a claim is made. And, that is just the start of the process after an accident. If the case cannot be settled through negotiation with the insurance company, then a lawsuit has to be filed. The complexity of moving a case forward gets infinitely more difficult once a lawsuit is filed and Court procedure has to be followed. Failure to follow the Court’s procedures can result in the permanent dismissal of a case. You or your relative or your friend should at a minimum talk to an attorney and almost certainly hire an attorney to represent you if you have been injured in a car accident.
What about if you are at fault for an accident? Should you hire a lawyer right away in that situation? Craig P. Kenny & Associates is happy to represent you on any traffic citation issued to you for causing an accident. We do that for the small fee of $50 for administrative costs and in many cases can keep the ticket from resulting in points on your license keeping your auto insurance rates reduced. So, even if you are at fault for an accident and you get a ticket, it is good to hire an attorney.
When shouldn’t you hire an attorney even if you have been in an accident? The answer is when you are not at fault for the accident and you are not hurt in the accident. If you are not hurt in an accident and the other driver and their insurance company is accepting fault for the accident, you probably don’t need to hire an attorney. But, you can always still talk to an attorney for free here at Craig P. Kenny & Associates. So, bottom line, the best course of action when you have been in an accident is to call and ask an attorney here at Craig P. Kenny & Associates for a free consultation.
